Gina Carano's Disney Lawsuit Advances in Federal Court

A federal judge has ruled that Gina Carano's lawsuit against Disney for wrongful termination can proceed, rejecting Disney's motion to dismiss the case. Carano, who was fired from 'The Mandalorian' in 2021 over her social media posts, claims her termination was due to her conservative political views. Disney argued that it had the First Amendment right to disassociate from Carano to protect its values, but Judge Sherilyn Peace Garnett found that Disney failed to provide sufficient evidence that its employment decisions are based on promoting specific values. The judge also noted that Disney, unlike nonprofits such as the Boy Scouts, cannot claim a constitutional right to fire employees based on perceived values. The case will either proceed to trial or potentially lead to a settlement.
